Terms of Engagement

Digital Sovereignty is technical infrastructure for independent operator capability assessment of AI systems. Brainiac Ltd provides installation, configuration, and the operational layer. The product does not provide legal certification of compliance with any regulation.

The Proof of Operator seal is a cryptographic record (SHA-256) evidencing that an operator assessment was conducted. The seal constitutes evidence that an assessment took place, not a guarantee of operator capability and not a confirmation of compliance with EU Regulation 2024/1689.

The seal is valid for 12 months from issue. After this period we recommend a fresh assessment. Earlier versions of the audit tool stated that the seal does not expire; this has been corrected.

The assessment is performed by Brainiac Ltd as an independent party. It is not a certification by an accredited body. Assessment outcomes depend on information supplied by the client and on the hardware configuration at the time of assessment.

Services are provided as is. Brainiac Ltd is not liable for regulatory decisions, administrative proceedings, or other consequences based on the seal or assessment outcomes. Companies should consult their own legal counsel regarding compliance with the EU AI Act and other regulations.

The audit tool runs in the client's browser. No personal data is transmitted to Brainiac Ltd servers during the audit. The seal and associated metadata are stored for subsequent verification. Data handling is GDPR-conscious.

These terms are governed by English law. Any disputes are subject to the exclusive jurisdiction of the courts of London, United Kingdom.
